1. Extent of validity

Customers, who access the server of Limbic Personality LLC, have to accept these terms and conditions with every paid order and thereby conclude a contract with Limbic Personality LLC. The services are provided only with the recognition of these General Terms and Conditions.

Limbic Personality LLC assures that the services are provided with the necessary care. When the offer is used for a fee, the data required for billing, the data marked as mandatory fields during registration and the answers to personality analysis questions are stored.


2. Access and Ordering on www.limbic-personality.com

2.1.  Visiting the website

Access to www.limbic-personality.com is via the Internet. For the visit of the Internet page and the correct display of texts and graphics, the customer needs a current browser (Microsoft Internet Explorer 6.0 or higher and comparable browser).
Visiting the Internet-Site is without obligation and free of charge provided no services which bear charges are used.


2.2.  Ordering services for a fee (conducting of Limbic Personality Analyses to determine the limbic personality structure)

The use of the services, in particular the performance of Limbic Personality Checks, are carried out online via the Internet. When visiting the website, the customer first chooses the language desired by him/her. The terms and conditions and the analysis are displayed in the selected language. If the customer wishes to have his or her limbic personality structure determined personally, he or she can access the desired page via the corresponding menu item on the Internet page. Customer for Limbic Personality LLC is always and exclusively those persons who carry out analyses with the help of a personal username and password.

For the execution, the customer must register on this page by form, confirm that he/she accepts the terms and conditions without reservation and pay the Limbic Personality Analysis by credit card (VISA or MasterCard) or bank transfer in advance. Thus the contract between the customers and the Limbic Personality LLC comes off.

All payment transactions are completely processed by an external, approved payment provider in the secure zone (128-bit encrypted payment software). At no time does Limbic Personality LLC gain insight into the credit card data of the customers. After receiving the payment confirmation, customers can generate their usernames and passwords. After confirmation, you can access the protected area of the website and fill in the desired Limbic Personality Analyses online. The analysis can be carried out in several stages. The renewed access takes place in each case via username & password.

After filling in the last question, the Limbic Personality Analyses are immediately evaluated and made available for download in the form of a PDF file. Limbic Personality LLC makes the results available to the customer as part of the service in its protected area of the Internet site for 15 years for viewing and downloading. After the expiration of this period, Limbic Personality LLC is entitled to delete the access authorization (username, password) as well as the results.

Access to the evaluations is only possible with the username and personal password. The customer is therefore fully responsible for the confidential storage of individual user data and for all activities that are carried out via this personal access. This also applies in particular if the customer has received the access data from a third party. The customer is aware that he/she must ensure to whom access to this data is granted. Limbic Personality LLC cannot be prosecuted in any form for damages of any kind which arise in connection with the use of the access by persons other than the registered customer.

The data stored by Limbic Personality LLC are regarded as proof of all transactions and services carried out between it and the customer. The data stored by the payment system shall be considered as proof of the financial transactions. Once the credit card details have been entered for payment, customers can no longer revoke their order.


3. Extent of the services, delivery, time limits, liability

The various services offered are only valid as long as they are listed on the website. The illustrations shown on the website are for illustration purposes only and are not binding. Limbic Personality LLC declines any responsibility for possible errors or inaccuracies of the illustrations, diagrams, explanations etc. which are contained on the website or in the catalogues and leaflets of Limbic Personality LLC.

Limbic Personality LLC expressly reserves the right to change, supplement or delete parts of the Internet site or the entire offer without prior notice or to cease publication temporarily or permanently.

Customers are advised that communication via the Internet is neither secure nor confidential, that information is intercepted and changed, that it is lost, deleted and may arrive late or incomplete. By answering the questions and downloading the results, customers consciously accept the uncertainty of Internet communication and the possible technical delays associated with the use of the Internet (server failure, etc.).

The online offer is generally available 24 hours a day. However, Limbic Personality LLC cannot guarantee the accessibility of the online offer. In the event of temporary unavailability, customers' entitlement to services that have already been paid for but not yet received shall remain unaffected. If a party cannot fulfil its contractual obligations despite all due care due to force majeure such as natural events of special intensity, war, strikes, unforeseen official restrictions and criminal attacks on the systems by third parties (hackers) etc., performance of the contract shall be postponed in accordance with the event that has occurred (plus an appropriate start-up period). The customer is only entitled to a refund or withdrawal from the contract after a delay of seven working days.
 

4. Pricing, foreign currencies

Existing business relationships or ongoing services with Limbic Personality LLC do not entitle you to purchase additional analyzes, products or services offered on the website free of charge.
The price of the service chosen is expressed in Swiss Francs (CHF), Euros (EUR) and US Dollars. The prices stated on the website apply to the analyzes. The decisive factor is the price in CHF alone; the figures in EUR and USD are fixed exchange rates. The conversion of the CHF price into the national currency of the customer is carried out by his credit card company at the current daily rate. Any costs, expenses and fees for the transaction (for conversion into foreign currency, etc.) charged to the customer by the credit card company as a result of the credit card agreement will be borne by the customer.

Limbic Personality LLC reserves the right to change prices at any time. For executed orders, the prices stated at the time of order apply.

The services of Limbic Personality LLC are subject to Swiss VAT (VAT) in the respective amount for customers in Switzerland (currently 7.7%, see Article 5 and Article 14 (2) (d) of the Swiss VAT Act). For all other customers, the prices for the products of Limbic Personality GmbH are final prices excluding VAT.


5. Privacy Policy

In the case of an order, the customer's data is stored for payment processing, insofar as this is necessary for invoicing. The personal data of the customer for personalization of the question evaluation as well as the question evaluation are also stored as such. The customer agrees that the anonymized evaluation results are statistically processed and used for research, in particular for the further development of the test.

The personal data of customers will neither be passed on to third parties nor will third parties gain insight into it. Limbic Personality LLC adheres to the applicable legal provisions on data protection (in particular to the Swiss Federal Act on Data Protection of 19 June 1992 and - insofar as services are offered to persons in the European Union - to the EU General Data Protection Regulation). Limbic Personality LLC is not bound to any further-reaching protective provisions of other countries.

The customer can request the deletion of his/her entire customer account and all results stored in it at any time. All you need to do is send an email with your first name, surname and user name to the following email address: info@limbic-personality.com

7. Literary property and Copyright

For the duration of the contract, the customer receives the non-transferable, non-exclusive right to use the chosen service.

All intellectual property rights regarding the entire test material (questions, accompanying texts, test results, evaluations, texts sent to the customer etc.) remain with Limbic Personality LLC or the authorized third parties. As far as third parties are entitled to the rights, Limbic Personality LLC guarantees that it has the corresponding rights of use and distribution. Any use, duplication or distribution of the test material by the customer beyond personal use is not permitted in any way without the written consent of Limbic Personality LLC.


8. Legal validity

Should any provision of these GTC be or become wholly or partially invalid for legal or factual reasons, this shall not affect the validity of the remaining provisions. In this case, the contracting parties undertake to replace the invalid provision by a provision which most closely corresponds to the intended content of the contract in a legally permissible form.


9. Applicable Law and Place of Jurisdiction

Place of performance, place of debt collection (the latter for customers domiciled abroad) and place of jurisdiction is Wangen SZ (Switzerland). Limbic Personality LLC is, however, also entitled to sue customers at the court in their place of residence or at any other competent court.
